Legal Provisions of Section 200 of Indian Penal Code, 1860.
Using as true such declaration knowing it to be false:
ADVERTISEMENTS:
Whereas section 198 of the Code penalises using as true a certificate known to be false, this section punishes using as true such declaration knowing it to be false. The section says that whoever either corruptly uses or attempts to use as true any such declaration with the knowledge that the same is false in any material point, shall be punished in the same manner as if he gave false evidence. The use or attempt to use the declaration must be corrupt, and the accused must know that such declaration is false in any material point. The explanation attached to the section clarifies that a declaration’ which is not admissible merely because there exists some informality is a declaration within the meaning of both section 199 and section 200.
The offence under this section is non-cognizable, bailable and non-compoundable, and is triable by court of session, metropolitan magistrate or magistrate of the first class.
